The AFL today confirmed that General Manager Football Operations, Adrian Anderson has exercised his discretion not to approve a proposed new arrangement between Chris Judd and Visy being excluded from Carlton’s Additional Services Agreement (ASA) limit or Total Player Payments (TPP).

 

The consequence of this decision means that any future payments made under arrangements between Chris Judd and Visy need to be included in Carlton’s ASA limit or TPP.

 

Player Judd and the Club were informed of the decision on 22 October 2012 under the relevant provisions of the AFL Player Rules and the CBA and the guidelines contained in the TPP Assurance & Advice Department – Contracting Process & Total Player Payment Administration Manual.

 

A previous arrangement between Chris Judd and Visy had been approved by the AFL as an employment agreement in 2008. Since that time and with the advent of free agency, the AFL has tightened the criteria for the approval of such third party arrangements.

 

Mr Anderson said the AFL would continue to carefully scrutinise related-party deals for players based on a range of factors including timing of the arrangement, the related commercial value of the arrangement, and the degree of independence between the Club, the governance of the Club and the third party.

 

“It is not appropriate to release my specific reasons for exercising my discretion in this case to refuse approval for the arrangements to be excluded from Carlton’s salary cap apart from confirming that my decision is related to a tightening of the rules that apply in such cases.
